Terms of sale (ver. 2019/12)

On-line sales by JOSU 1818 SRL U.S. are governed by current Italian regulations regarding mail order sales with the right of withdrawal.

Each order transmitted constitutes explicit acceptance of the rules and conditions of supply and authorizes JOSU 1818 SRL U.S. to charge the customer the total amount, including the contribution for shipping costs.

The products will be delivered by express courier.

The data provided by the customer when ordering will be included in the invoice. The issuance of the invoice is simultaneous with the departure of the products and is sent electronically to the email address provided by the customer. No changes will be possible after the invoice is issued.

The wording ‘available’ at the time of the order is purely indicative for overstocking or the possibility of multiple purchases at the same instant by multiple users. For this reason, JOSU 1818 SRL U.S. reserves the right, once the order is received, to check availability and failing that to notify the customer by e-mail. The customer may decide whether to wait for the missing item, replace it or exclude it from the order.

Delivery times for goods are approximate and are subject to change without notification.

PRODUCT WARRANTY

In case of lack of conformity JOSU 1818 SRL U.S. provides for the restoration of conformity of the product by repair/replacement, carried out directly by the manufacturer or by the service centers authorized by the same and present in the territory. In the event that, for any reason, JOSU 1818 SRL U.S. is not able to return to its customer a product under warranty (repaired or replaced), JOSU 1818 SRL U.S. may proceed at its own discretion to refund the full amount paid or replacement with a product with equal or superior characteristics.

Repairs or replacements may also be made with parts or products that are not necessarily the same as the defective products contained in the original delivery, but are nevertheless equivalent to or superior to new parts and products in terms of functionality, performance and aesthetics.

The warranty covers only factory defects and product nonconformity. Except for the replacement of defective and non-conforming products, JOSU 1818 SRL U.S. assumes no responsibility for direct and indirect damages that may result from the use, even improper, of the product by the recipient.

All shipments of products will be returned to the sender at the sender’s expense:

• Not including original packaging, accessories and forms
• Received with unsuitable or inadequate outer packaging and therefore damaged in transit
• The warranty does not cover damage due to failure to use the original packaging and adequate protective outer safety packaging not authorized by the service center.

If the product is found to have been tampered with or the labels identifying the serial number are found to have been removed or tampered with, JOSU 1818 SRL U.S. reserves the right to judge the validity of the warranty.

Warning. The product warranty remains completely unchanged effective from the date of purchase.

Attention. The costs for the replacement of the product shall be borne by JOSU 1818 SRL U.S., however, in the event that the reported anomaly does not exist or the warranty is no longer valid for any reason, at the time of shipment, a flat rate transportation cost of € 30 will be charged.

RIGHT OF WITHDRAWAL

The customer may exercise the right of withdrawal in accordance with Legislative Decree 206/2005 in the following manner and terms:

The consumer must express the will to withdraw from the purchase within 14 working days from the receipt of the goods themselves, this communication must be anticipated by e-mail ( info@querciamatta.it ) provided that it is confirmed by registered mail with return receipt within 48 hours.

The return must be made, at the same time, within 10 working days from receipt of the goods to the following address:

provided that:

• the products have not been used or damaged;
• the returned merchandise must be received undamaged, complete with all accessories and labels and in its undamaged original packaging;
• the returned merchandise is accompanied by a document indicating the number and date of the invoice for the product;
• the transportation related to the returned goods is borne by the purchaser;
• the responsibility for the loss or deterioration of the returned goods is borne entirely by the Customer.

The refund of the sums paid will be made as soon as possible and in any case within 30 days of receipt of the notice of withdrawal. Excluded from the refund are amounts related to shipping costs and any cash-on-delivery charges. In case of product sent with free shipping, the cost of standard shipping will be deducted from the refund.

The amount related to the returned goods will be sent to the customer by bank transfer, after communication of the bank details by the customer. In case of payment through Paypal or Credit Card, the amounts will be refunded by the same means.
